Doran & Murphy has a great deal of legal and trial experience representing workers hurt on the railroad during the course of their employment. We have won settlements for our clients who suffered traumatic injuries in the following situations:

  • A 62 year old suffered a knee injury when he tripped on a locomotive
  • A conductor injured his lower back while setting the handbrake on a railroad car
  • An engineer suffered a head injury during a derailment
  • An engineer sustained soft tissue cervical damaged when a gondola car struck his locomotive
  • A conductor suffered a knee injury when he slipped on iron ore pellets in the railroad yard
  • A conductor’s shoulder was injured after he fell on some oil that was spilled on the locomotive’s steps
  • A conductor injured his knee during an accident on a locomotive
  • A conductor who suffered a knee injury where ballast shifted under his foot

The law is on your side

For over 26 years, the attorneys at Doran & Murphy have been fighting for the rights of the injured. We have used several statutes of law in advocating for our clients. Some of the applicable matters of law include:

Federal Employers Liability Act – Federal Safety Appliance Act: Congress enacted the Federal Employers Liability Act (FELA) to help railroad workers seek compensation for injuries sustained by the negligence of their employers. The Federal Safety Appliance Act specifically states that it is not legal for a railroad to run a car without enough air brakes to allow the conductor to safely stop the train. It also states that the cars must be secured by couplers that could be automatically coupled and uncoupled “without the necessity of men going between the ends of the cars".

Federal Railroad Administration: This agency was created in order to enforce railroad safety as well as conduct research in the development of better safety measures. Doran & Murphy is familiar with the administration and what regulations they have enacted to ensure the safety of all railroad workers.

Locomotive Inspection Act: This act was created in order to assure that all locomotives being used are safe. When an unsafe locomotive is not immediately removed from usage on the railroad, the results can be catastrophic. Doran & Murphy is familiar with this act and the destruction that can occur when it is not adhered to.
